Our General Terms and Conditions including Data Privacy Policies
1.1. In these General Terms and Conditions, the terms below have the following meaning:
TEDxUniMannheim event: The event taking place on the 22nd of September 2018 in Mannheim;
MaXperience e.V.: The student initiative organizing the TEDxUniMannheim event, including all independent organisers of the TEDxUniMannheim event;
User: The natural person and/or legal entity using this form to apply for a ticket for the TEDxUniMannheim event;
2 APPLICABILITY OF THE GENERAL TERMS AND CONDITIONS
2.1. These terms are the only conditions upon which MaXperience e.V. is prepared to deal. All other terms or conditions are excluded to the fullest extent permitted by law. The User waives any right which it otherwise might have to rely on any other terms and conditions which are not contained in these terms.
2.2. No variation to these terms shall be binding unless expressly agreed in writing by MaXperience e.V..
2.3 Any queries regarding the Terms and Conditions should be raised by the user prior to application. Application and/or use of a ticket/s to the TEDxUniMannheim event shall constitute acceptance of the Full Terms and Conditions. All tickets are the property of MaXperience e.V. until paid in full.
2.4. The user undertakes to observe and uphold the terms and conditions, additional directives and statements of MaXperience e.V. at all times. All directives and statements printed on the tickets, posted or announced at the TEDxUniMannheim event website or Facebook Page of these Terms and Conditions. In the instance of a breach of this undertaking MaXperience e.V. reserves the right to cancel the ticket and eject the offender and retain all monies paid.
3 TICKET APPLICATION
3.1. MaXperience e.V. decides based on this form which User will have the opportunity to buy a ticket for the TEDxUniMannheim event.
3.2. After a decision is made by MaXperience e.V., the user will be informed via email about whether or not it was granted the possibility to buy a ticket.
3.3. The application process closes at 11:59 pm on the September, 15th. Any applications submitted after that cannot be taken into consideration.
4 TICKET SALE
4.1. Only if the user has granted the permission to buy a ticket via email it can buy a ticket.
4.2. Tickets will be personalized. The user is required to carry ID during pickup and the TEDxUniMannheim event. If the user cannot identify itself, it is not granted permission to buy a ticket or to enter the TEDxUniMannheim event.
4.3. Ticket prices are 30€ regular and 20€ for students. Only if the user shows its student ID upon ticket pickup and entry of the TEDxUniMannheim event, it is granted the student price.
4.4. The ticket sale will take place on September, 22th 2018,two hours before the event starts in the Hays Forum (Uni Mannheim). The tickets can only be paid in cash.
4.5. If the user has chosen to pick up the ticket but cannot attend the ticket sale, it is the user’s responsibility to contact MaXperience e.V. (info@tedxunimannheim.de or +49 0176 345 796 35) to agree on a different pickup date.
4.6. If the user has not picked up its ticket half an hour before the event (22.09.2018) it loses its right to buy a ticket and to attend the TEDxUniMannheim event. MaXperience e.V. can choose another user to sell this ticket to.
5 REFUND OF BOUGHT TICKETS
5.1. A request to refund a ticket can be made only up until 18:00 on September, 20th 2017. Any later requests cannot be processed.
5.2. It is the user’s responsibility to contact MaXperience e.V. immediately via email (info@tedxunimannheim.de) to amend the registration and request a refund.
5.3. Should the TEDxUniMannheim event be canceled or postponed due to unforeseen circumstances, MaXperience e.V. will process a full refund within 90 days of such circumstances becoming known. It is the user’s responsibility to contact MaXperience e.V. to agree on a time and place to exchange the ticket for the refund.
5.4. MaXperience e.V. will issue a refund only in cash and only in exchange for the personalized ticket.
6 LOSS OF THE TICKET
6.1. If the user loses, destroys or has its ticket stolen, a copy can be issued only under the following conditions:
The user can ensure MaXperience e.V. that it has already paid for the ticket.
A fee of 3€ has to be paid in order to receive a new ticket.
6.2. In the case of loss of the ticket, it is the user’s responsibility to proof its identity to MaXperience e.V. to access to the TEDxUniMannheim event.
7 RESELLING OF TICKETS
7.1. It is strictly forbidden to give away or sell already bought tickets to any other third party. The personalized ticket is only valid for the user it has been issued to.
7.2. Any attempt to sell or give away the ticket can lead to the exclusion of the TEDxUniMannheim event.
8. FILM AND AUDIO RECORDINGS
8.1 Due to copyright protection laws, recording of digital audio and / or film footage during the TEDxUniMannheim event is strictly forbidden.
8.2 If the user violates the copyright protection laws, MaXperience e.V. as well as a third party involved in those violations can and will raise a claim for compensation for damages.
8.3 Moreover, persons violating the copyright term mentioned above have to withdraw all recordings of digital audio and / or film footage and delete them permanently. In any case of copyright violation, the user involved is going to be expelled from the TEDxUniMannheim event, regardless of the remaining time of the TEDxUniMannheim event.
8.4. The user accepts that an authorized production team hired by MaXperience e.V. will carry out general filming and sound recording in or about the venue of the TEDxUniMannheim event. These recordings can be used for any purpose of MaXperience e.V. and will be uploaded to the TEDx Talks Youtube Chanel (https://www.youtube.com/user/TEDxTalks) and the TED website (http://www.ted.com/watch/tedx-talks). The user consents to itself and its party to being photographed, filmed and sound recorded as an audience without payment, to the publication of the films and recordings on YouTube and the TED website and to the commercial exploitation of such films and recordings without payment.
8.5. As a matter of course, all German copyright protection laws remain unaffected.
9. ENTRY TO THE TEDXUNIMANNHEIM EVENT
9.1. Only upon presentation of a valid ticket, access to the TEDxUniMannheim event will be granted. Discounted student tickets require a verification of the discount entitlement (e.g. student ID).
9.2. Discounted tickets are only valid together with a verification of the discount entitlement. Visitors, that cannot show this verification at the entrance, cannot utilize the discount. If the difference of the prices will not be paid at the entrance, access to the TEDxUniMannheim event will not be granted.
9.3. In the case of a late arrival of the visitor, due to a force majeure or self-inflicted, a refund of the ticket price cannot be claimed.
10.SAFETY AND ENJOYMENT
10.1. To attend the TEDxUniMannheim event, the user has to obey the rules stated below at any time.
10.2. Attendees of the TEDxUniMannheim event are not allowed to bring cameras or recording devices into the room of the TEDxUniMannheim event. Mobile phones and other electronic equipment must be switched off (not silenced) before entering the auditorium. Any recording of film or audio material in the venue is strictly forbidden, especially flash photography.
10.3. If attendees disrupt or disturb the ongoing of the TEDxUniMannheim event in any way, they will be expelled from the TEDxUniMannheim event, regardless of the remaining time. MaXperience e.V. reserves the right to refuse admission and may request any User to leave (taking any such appropriate action which may be necessary to enforce this right) before or during the TEDxUniMannheim event if it considers it to be necessary or desirable to do so. MaXperience e.V. may also, on certain occasions, have to conduct security searches to ensure the safety of its patrons.
10.4. If there is a dangerous disturbance of any form, the access to the TEDxUniMannheim event can be denied for all users. MaXperience e.V. is not covenanted to refund the ticket price.
10.5. Attendees have to hand bulky items over to the staff at the checkroom. Those items can not be taken into the room of the TEDxUniMannheim event.
10.6. Smoking is strictly forbidden in all rooms of the TEDxUniMannheim event.
10.7. Where reasonably necessary, MaXperience e.V. reserves the right to alter and amend the advertised artistes / performers, site facilities, schedules, programmes and performances without prior notice and without liability. MaXperience e.V. reserves the right to replace the advertised headlined speakers.
11. LIABILITY OF MAXPERIENCE E.V.
11.1. Admission to the TEDxUniMannheim event are at the user’s own risk. Excepting where caused by their act or omission, MaXperience e.V., any sub-contractors, and the Venue shall not be held liable for any loss, injury or damages sustained within the Venue, all designated car parks and all associated areas. There is strictly no admittance to the Venue or its associated areas before the advertised opening times. For damages by any third party, only the causer is liable.
11.2. MaXperience e.V. will not be liable for any losses incurred by the user in connection with the user’s use of the TEDxUniMannheim website, for any delay in using or the user’s inability to use the website, for any information obtained through the website or for any material posted to the website by MaXperience e.V. or by users of the website.
11.3. The user agrees to indemnify MaXperience e.V. against any loss, injury or damage caused to themselves or others by their own actions, negligence and/or nuisance or by any other person in their care or equipment, apparatus and/or belonging/s in their possession.
12 COMMENCEMENT AND TERMINATION
12.1. These terms shall commence on the date (‘Commencement date’) that the User accepts these General Terms and Conditions. The user is not able to apply for tickets for the TEDxUniMannheim event without accepting these Terms and Conditions and they continue for the Initial Term and shall thereafter continue for a further year on each anniversary of the Commencement Date unless terminated by either party giving to the other not less than one month’s written notice prior to the expiry of the Initial Term or the current annual term.
12.2. Either party shall be entitled to terminate these terms with immediate effect on written notice to the other party in the event that the other party shall be in material breach of its obligations hereunder and shall have failed to remedy such breach within thirty (30) days of receipt of written notice specifying the breach and requiring its remedy without prejudice to any right it may have in respect of that or any antecedent breach.
12.3. Upon termination any sums owing shall become immediately payable.
13 FORCE MAJEURE
13.1. MaXperience e.V. shall be excused performance if it is prevented from performing its obligations by any event beyond its reasonable control including but not limited to war, riot, civil commotion, strike, lock-out, accident, embargoes, perils of the air, or some other industrial action, unavailability of telecommunications services, Act of God, storm, fire, earthquake, explosion, flood, electrical failure, failure of lighting and sound equipment, storms, disease, fog, snow, frost, confiscation and action of any government or governmental agency.
14 CHOICE OF LAW AND JURISDICTION
14.1. These terms shall be interpreted according to German law and the parties submit to the exclusive jurisdiction of the German courts.
15. SEVERABILITY
15.1. If any part of these terms and conditions is held to be unenforceable this will not affect the enforceability of the remaining provisions.[/vc_column_text][/vc_column][/vc_row]
